Florida Department of Revenue alleges father owes back child support of $85,000 to the mother of three children. After a two-day trial, the court finds no child support is due to the mother, and parental responsibility of the children changed from the mother to the father, even though the court did not order the change in custody.

Divorce & Child Custody Case in Martin County

The husband contested the dissolution of marriage. He did not want to permit children to relocate to southern California with the wife after disclosing a new relationship in Florida. After trial, the mother was permitted to relocate to California. The husband tried to contest the Florida court decision in California. The California court upheld Florida’s decision based on specific language in Florida ruling that Richard Gitlen insisted on being placed in the Florida court order for the wife’s protection, anticipating the husband would contest the ruling in the California court.

Domestic Battery Case in Okeechobee County

Domestic battery allegations of frequent abuse regularly against the wife were finally prosecuted after the court granted a domestic violence injunction for the protection of the wife.

Child Custody Case in St. Lucie County

The relocation of minor children to New York City by the mother is denied by the court, even though the mother claimed she was losing her employment as CPA/Financial Officer and father did not regularly visit with the children. Three hearings convinced the court mother had ample opportunity in Florida to find alternative employment should her current job be eliminated, and father was committed to being a large part of the children’s lives.

DUI Vehicular Homicide Case in Martin County

Client was accused of DUI vehicular homicide, killing one driver and causing multiple injuries to another person. Facing a life sentence in the Department of Corrections, the client receives a substantial reduction at criminal sentencing despite objects of the state attorney due to mitigating circumstances.

Estate Contestion Case in Okeechobee County

The father’s estate was contested by children and stepmother. After trial, family homestead kept by children.

Robbery Charges in St. Lucie County

Man accused of robbery with a deadly weapon; all charges dropped after hearing concerning the existence of a handgun.
